1Acceptance of Terms

By accessing, browsing, or using Ghostmark (accessible at https://ghostmark.site, including all related subdomains, APIs, and services), you ("User", "Customer", or "You") agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy.

If you do not agree to all of these Terms, you must not access or use Ghostmark. This agreement is operated and maintained by Ghostmark (founded and operated by Sayan, Kolkata, West Bengal, India).

2Description of Service

Ghostmark provides an AI-powered automated video processing service that detects and erases watermarks, logos, timestamps, and subtitles from user-submitted video footage using temporal inpainting computer vision models.

The service is provided in both free and paid capacities:

• Free Tier: Includes up to 5 complimentary video cleans (up to 1080p resolution).
• Pro Membership: Paid recurring subscription offering unlimited video cleans, 4K UHD 60fps processing, and priority GPU inpainting pipelines.
• Pay-As-You-Go Credit Pack: One-time payment for 50 video credits that do not expire.

3User Accounts & Cookie Sessions

Ghostmark utilizes cookie-based session tracking (wm_session) and optional registered accounts to monitor usage counters and active credit balances. You are responsible for maintaining the confidentiality of your session identifier and credentials. Ghostmark is not liable for loss resulting from unauthorized access caused by clearing or sharing your local session tokens.

4Pricing, Billing & Payment Terms

All pricing is transparently displayed on our Pricing Page. Prices are dynamically denominated based on geographical location:

• Indian Visitors: Prices are charged in Indian Rupees (INR, ₹) processed securely via Razorpay, supporting UPI (Google Pay, PhonePe, Paytm, BHIM), Credit/Debit Cards, NetBanking, and Wallets.
• International Visitors: Prices are charged in United States Dollars (USD, $) processed via authorized international payment gateways.

Subscriptions renew automatically on a recurring monthly billing cycle until canceled by the user. You may cancel your subscription at any time without fees or penalties. One-time credit packs are charged once with zero recurring commitments.

5Cancellation & Refund Policy

Ghostmark offers a comprehensive 7-Day Risk-Free Money-Back Guarantee. If our inpaint algorithm is technically unable to restore your footage or you are unsatisfied with the quality, you may request a 100% full refund within 7 days by emailing sayandevelops@gmail.com with your Payment ID.

6Intellectual Property, Copyright & User Responsibilities

You retain all ownership rights, copyright, and title to any video content you upload to Ghostmark. Ghostmark does not claim any intellectual property rights or ownership in your videos.

User Warranties: You represent and warrant that you possess the necessary licenses, rights, or lawful fair-use authorizations to modify the video content you submit to the platform. Ghostmark provides this utility tool for lawful purposes such as removing accidental overlays, dates, promotional badges, or watermarks from your own footage, client footage, or authorized fair-use material. You agree not to use Ghostmark to infringe upon any third party's copyrighted works or intellectual property.

7Zero File Retention & Privacy

We maintain a strict Zero-Retention Policy: All uploaded video files and processed output files are temporarily stored in private sandbox worker directories and automatically purged within 1 hour. No video files are permanently stored, publicly indexed, or used to train third-party public models. Please review our Privacy Policy for full details.

8Prohibited Conduct

Users agree not to:

• Upload material that is illegal, defamatory, harmful, sexually explicit involving minors, or violating applicable national or international laws.
• Reverse engineer, decompile, or attempt to extract source algorithms or proprietary neural network weights without written consent.
• Attempt to disrupt platform availability via denial-of-service (DoS) attacks, automated bot abuse, or malicious payloads.

9Disclaimer of Warranties & Limitation of Liability

Ghostmark is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied. While we strive for pristine, seamless inpainting accuracy, we do not warrant that all video artifacts or complex watermarks will be 100% imperceptible under every lighting and motion condition.

To the fullest extent permitted by applicable law, Ghostmark shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use the platform. In any event, Ghostmark's total liability shall not exceed the amount paid by you in the 3 months preceding the event giving rise to liability.

10Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to them or the services shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The competent courts in Kolkata, West Bengal, India shall have exclusive jurisdiction over any legal proceedings.
